Franchise Terms and Conditions

Please read these terms and conditions carefully before applying for the franchise of Modern Computer Institute Private Limited, its official website is www.moderncomputer.org / www.moderncomputerinstitute.com. You agree to be bound by all the terms and conditions of this Agreement.

By accessing or using the Serices, you agree to be bound by these Terms. if you disagree with any part of the Terms then legally you not access the services provided by Modern Computer Institute Private Limited.

References in this Agreement include the policies and guidelines given below. Reserves the right to add, update, delete, and change the terms and conditions of this Agreement at any time by posting any changes or amended agreements on this website. MCI will change the changes or modifications by indicating the date it was last modified at the top of this Agreement. The Company/Organization is an ISO 9001:2015 certified professional organization, and is in the business of designing and developing short-term skill development courses and programs, and provides training of such courses to interested students, professionals, employees, through their franchise outlets (authorized training centres) on a national basis. entrepreneurs and feelancers; Training, conducting competitions, exams, certifications and franchise network development are also part of the franchisee's business.

The list of the said course content along with the detailed syllabus of each course is available under the "Courses" menu on the Website.

The Head Branch has agreed to award the franchisee to the franchisee so that the said course material can be conducted, managed and operated in accordance with the terms and conditions contained herein.

Terms of Offer

The Franchisee/ you warrant and represent to the Franchiser that you are a company/ firm / organization, validly existing, having a good standing under laws of India and as such has all requisite power and authority to enter into this agreement with the Franchiser on terms and conditions herein contained.
You hereby have the right to use and share the said course material designed by the Head Branch to provide vocational training to your students at your institution, in accordance with the course provided for the said course, after the approval of your franchisee by Head Branch.
We Guarantee 100 Numbers of student Assured strength of students to Franchisee within one year.
That any new Franchise/centers can be opened by Modern Computer Institute Pvt. Ltd. anywhere in your assigned Area. However, if any centre insists not to open new centre in his/her range which affects his business i.e., 3 KM away in Urban area & 5 KM in case of Rural Area.
After registering on this website, you will be sent an email with login details on your registered mail id. You must login with these details and upload scanned documents that belong to you personally and to the registered institution and notify the Head Office of the Modern Computer Institute™ Pvt. Ltd. via email or phone call. The Modern Computer Institute™ Pvt. Ltd. will approve the franchise on satisfactory perusal of the uploaded documents and all the features of the Online Web Portal and the franchisees will be made available for further use.
It is the sole responsibility of the franchise to fix and charge fees from the students to be kept with them, the franchisee is also required to pay tax on the amount collected from the students as per Indian laws. Modern Computer Institute™ Pvt. Ltd. shall not be responsible for the payment or refund of any collected fees and taxes applicable to the franchisee under any circumstances.
The franchisee shall be solely responsible for the operation and sharing of the said course material with its students (whether it is necessary to specify the requirement of infrastructure, software, hardware, staff, equipment, etc.). It is the responsibility of the franchise to buy the requirements at their own cost. Modern Computer Institute™ Pvt. Ltd. will not bear any expenses for this.
Modern Computer Institute™ Pvt. Ltd. offers many businesses skill development short-term courses for students and franchise business. It is for the franchises to decide and choose which of these courses they want to start and operate at their institution. Franchisees are allowed to choose only those courses for which they have the necessary infrastructure in terms of software, hardware, trainers, equipment etc. At the same time, franchisees are also allowed to choose similar courses affiliated to other institutes.
The intellectual property rights and the name Modern Computer Institute™ Pvt. Ltd. in the said course material will remain with the Head Branch and the franchisee will not be entitled to make any amendments or changes. The franchisee shall act only as a distributor of the said course material provided by the Head Branch i.e., Modern Computer Institute™ Pvt. Ltd..
The franchise will not give any false commitment or information regarding the Modern Computer Institute™ Pvt. Ltd. to any student. The franchise shall be solely responsible for any such act or its outcome, the Modern Computer Institute™ takes no responsibility for such an act.
The franchisee will be responsible for completing the course and training of the student, failing which, the franchisee is solely responsible for all losses caused by non-compliance.
The franchise has to decide the fee structure for each course. The Modern Computer Institute™ Pvt. Ltd. recommends charging a reasonable fee for courses from franchisees, and expects, and nothing beyond that. This amount collected as fee will be considered as the income of the franchise. Modern Computer Institute™ will charge registration fee and examination fee on a per student basis.
It is expected that the best services and training will be provided to the student to maintain the brand value of modern computer institute™ in every way. In case of refunding fees to the student for any reason, only the franchise will be responsible for it.
The franchisee warrants and keeps all information exchanged with the Head Branch of a confidential nature strictly confidential and will not disclose it to third parties without the prior written consent of the Head Branch during the period of this agreement.
The franchisee will be responsible for the admission and registration of the student. And it is the responsibility of the franchise to train the students. During the course and training, franchises will provide information about practical knowledge and encourage students to set up their own business.
The franchise is responsible for providing the correct data of the students enrolled in its institution to modern computer institute™ Pvt. Ltd.. Franchisee is solely responsible for the consequences or loss of knowingly or unknowingly providing incorrect data of students.
The franchise will verify the photographs of each student. The data and photograph of the students will be printed on the certificate issued by the Modern Computer Institute™ Pvt. Ltd.. The Modern Computer Institute™ will also print the photo ID number when provided by the franchisee.
The Modern Computer Institute™ Pvt. Ltd. is authorized to use as a brand name for marketing franchise courses. It will be endeavored by the franchise not to use the brand name to mislead anyone because of the Modern Computer Institute™ Pvt. Ltd. and its brand image is not adversely affected in any way.
Modern Computer Institute™ Pvt. Ltd. will charge a nominal examination fee which includes student registration process, fee management system, online exam, paper-based exam, offline or practical examination and such other services. Modern Computer Institute™ Pvt. Ltd. for payment – The franchisee can charge students only to the extent to which the amount is to be paid to the Modern Computer Institute™ Pvt. Ltd. or the said fee can be borne out of the course fee collected by the franchisee. In any case, the Modern Computer Institute's™ Pvt. Ltd. laboratory is limited to the maximum limit of the amount collected.
Modern Computer Institute™ Pvt. Ltd. is obliged to deposit a large amount in the wallets available in franchise logins. The said amount can only be used by the franchisee to avail services from the Modern Computer Institute™ Pvt. Ltd. and will not be refunded under any circumstances. In some instances, the amount is automatically debited from the wallet depending on the use of the services.
Based on the online or offline data, After the certificate is prepared by the Modern Computer Institute™ Pvt. Ltd. (Hard Copy) is sent by Speed Post to the registered address of the franchise as soon as possible.
In the event of a change in the postal or email address, the franchise will notify the head branch of modern computer institute™ private limited .
Modern Computer Institute™ does not make any business commitment, job commitment, payment guarantee, marketing commitment to any student. If the franchisee makes any such claim or promise he will be solely responsible for it and its consequences.
Every franchise will make every effort to provide employment to students and girl students.
All franchisees will be determined to create a clean and pollution-free society around them, and from time to time will strive to conduct cleanliness drives, tree plantation and cultural programmers, etc.
Along with the Head Branch of the Modern Computer Institute™ Pvt. Ltd., it will be the responsibility of all franchisees to do their utmost to inculcate a sense of brotherhood, patriotism, honesty and discipline among students and citizens and organize programmers at the social level for this purpose.
Along with the Modern Computer Institute™ Pvt. Ltd. head branch, it will be the responsibility of all franchisees to request and contribute to the government and administration as much as possible to make the city or village crime-free.
In case of any situation like earthquake, flood, famine, extreme heat or other problems – Principal Branch will participate extensively in the security program run by the Government, and if required, the Principal Branch will also collect donation money from the Franchisee.
Franchise will not take any kind of bank loan or any other loan in the name of Modern Computer Institute™ Pvt. Ltd. (head branch). Nor will any claim in the future from any bank or other head branch.
The head of the franchise will do with the annual expenses or obligations such as office rent, class rent, electricity bill, water bill, local publicity, employee salary, etc. from the earned amount of self-training.
The franchisee will take immediate note of the complaints made by the students or other members and take appropriate measures to address those problems. If the Head branch receives a complaint against the franchisee or any of its members, by the students, and if it is certified, immediate action will be taken against them.
It is mandatory for the franchise to conduct the examination of students through the system and facilities provided by modern computer institute™ Pvt. Ltd., if the student fails the exam, the franchisee reserves the right to conduct the re-examination. The franchisee will submit data only in respect of the student who has cleared the examination. The franchisee will provide training to the students who failed in the exam and will assist and guide them in passing the exam.
It is assumed by modern computer institute™ Pvt. Ltd. that the franchise will not do any misconduct to pass students. It is detrimental to the franchises as well as the image of the Modern Computer Institute™ Pvt. Ltd.. The qualification certificate of any student shall be issued by the head branch of the franchisee. Any certificate issued by the franchise to the students shall be deemed invalid.
The franchisee will take the initiative necessary to acquire the job or guide students to start a business, if they want, according to the student's ability and qualifications. Franchisees will not commit to any job or business success.
To better help the franchise, the Head Branch reserves the right to use the franchisee's login panel and make the necessary changes without the franchise's prior permission.
All information related to the Modern Computer Institute™ Pvt. Ltd. has been published and updated from time to time on the official website of the Modern Computer Institute™ Pvt. Ltd.. The franchisee needs to provide the student with all the information about the Modern Computer Institute™ Pvt. Ltd. before admitting them to any course and insist that they go through the official website of the Modern Computer Institute™ Pvt. Ltd..
Certificate issued by Modern Computer Institute™ Pvt. Ltd. can be validated and verified through the number printed on the certificate on the official website.
The examination will be conducted by the Modern Computer Institute Pvt. Ltd. and the certificate will be issued only to those students who have enrolled in the Modern Computer Institute™ Pvt. Ltd. course.
Modern Computer Institute™ Pvt. Ltd. reserves the right to communicate by SMS, email or any other means at any time related to the course. At the time of admission, the franchise will have to seek approval for this commitment from the students.
The Modern Computer Institute™ Pvt. Ltd. will forward the certificate of students to the franchise, and the franchisee will in turn be responsible for handing it over to the students. The franchise will also provide postal charges to modern computer institute™ Pvt. Ltd..
Modern Computer Institute™ Pvt. Ltd. has adopted the online examination method and can conduct the exam throughout the year.
Modern Computer Institute™ Pvt. Ltd. has saved its data by taking backups. However, modern computer institute™ Pvt. Ltd. is not responsible for any loss of data. The franchisee is requested to keep all the data with them in another format, which they deem fit, which can be easily accessed by them.
The franchisee will purchase the best, high-speed internet connection at its own cost from a reliable service provider to provide the best education and training to students without any hindrance.
If the franchisee wants to close for any reason, or terminate the contract, they are obliged to report it to the Modern Computer Institute™ Pvt. Ltd. via letter or email, in the absence of which it is assumed that the franchise is active and operated. The membership will be terminated after the franchisee resigns and is accepted by the head branch.
Any member or director of the franchisee has been declared a criminal by the court, the membership of such franchisee shall be terminated immediately by the head branch.
Franchisee Modern Computer Institute™ Private Limited has only one branch, which can only take advantage of the name of the head branch as well as all its registrations, the franchisee can use the registered logo of the head branch with its branch name. That Modern Computer Institute Name & Logo can be used by Franchise for any branding/promotional purpose only for the authorized entity. Other Logos/Names like NIELIT, Microsoft, MSME, Trademark, ISO etc. which are associated with Modern Computer Institute™ Pvt. Ltd., cannot be used if centre name is different from Modern Computer Institute.
Any dispute, or claim arising out of the termination or invalidity of this Agreement or breach of the breach, shall be settled by sitting among the parties to arbitration and conciliation. If an agreement is not reached, it would be safe for any kind of legal settlement to be made by the Bhagalpur-Bihar court.
The Modern Computer Institute™ Pvt. Ltd. is neither running any government scheme nor taking any government grant. Modern Computer Institute is a self-reliant, self-organized organization in the business of designing courses for students. The modern computer institute™ Pvt. Ltd. aims to impart proper training to the students with the help of franchise network. Modern Computer Institute™ Pvt. Ltd. also issues certificates as well as mark sheets for certain courses.

By using this website, you agree to be bound by all terms and conditions of the Agreement.
